These Terms of Service ("Terms") govern access to and use of the Harbor Check platform ("Service") by sailing clubs, yacht clubs, camps, youth organizations, and their authorized staff and guardians ("you"). By using the Service, you agree to these Terms.
1. Service Usage
Harbor Check provides digital tools for session rosters, sailor check-in and check-out, guardian and pickup authorization via QR verification, Guardian Pass delivery, and attendance tracking. The Service is licensed, not sold, to authorized organizations. You agree to use the Service only for its intended purpose and in compliance with applicable laws.
You will not: (a) reverse engineer, copy, or resell the Service; (b) use the Service to transmit unlawful, harassing, or harmful content; (c) attempt to gain unauthorized access to any account, system, or data; or (d) interfere with the integrity or performance of the Service.
2. Accounts & Access
Organizations are responsible for the staff accounts they create, including maintaining the confidentiality of credentials and the accuracy of sailor, guardian, and authorization records. You agree to promptly notify us of any unauthorized account access.
3. User Responsibilities
You are solely responsible for:
- Verifying the identity of any individual presenting a QR pass or requesting a sailor pickup;
- Maintaining accurate sailor, guardian, session, and pickup authorization information;
- Obtaining all parental or guardian consents required to collect and process sailor information through the Service;
- Complying with applicable child safety, supervision, and emergency response obligations of your program; and
- Promptly reviewing attendance records, Guardian Pass status, and unauthorized pickup attempts surfaced by the Service.
Harbor Check is a tool that supports your operations. It does not replace trained supervision, staff judgment, or compliance with your organization's safety policies.
4. Email Communications
By providing an email address, guardians and authorized pickup parties consent to receive emails from Harbor Check related to Guardian Passes and pickup verification.
5. Liability Limitations
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that email or other communications will be delivered without delay.
To the maximum extent permitted by law, Harbor Check and its affiliates, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or use, arising out of or in connection with your use of the Service — including, without limitation, damages relating to the supervision of, injury to, or release of any program participant. Our total aggregate liability for any claim arising out of or relating to the Service will not exceed the fees paid by your organization for the Service in the twelve months preceding the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, in which case the limitations above apply to the fullest extent permitted by applicable law.
6. Indemnification
You agree to defend, indemnify, and hold harmless Harbor Check from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
7. Termination
We may suspend or terminate access to the Service at any time for violation of these Terms or to protect the safety or integrity of the Service. You may stop using the Service at any time.
8. Changes
We may update these Terms from time to time. Material changes will be communicated through the Service or by email to organization administrators.
